Thailand's Cabinet has approved a one-year postponement of the country's new national Employee Welfare Fund, pushing its start date from October 1, 2025 to October 1, 2026. The fund itself was not cancelled or scaled back, only deferred, and it remains a genuine new statutory payroll obligation that a foreign investor scaling a Thai FDA or DTAM cannabis license-holding entity past ten employees needs to plan for now, using the extra year of runway the postponement provides.
What the Employee Welfare Fund Is and Who It Applies To
The Employee Welfare Fund is a new national scheme requiring employers with ten or more staff to register and contribute on behalf of their workforce, unless the employer already provides a provident fund or a comparable benefit that meets the fund's requirements. Where it applies, both the employer and the employee contribute 0.25% of monthly wages each at the outset, with that rate scheduled to rise to 0.50% by 2031. This structure mirrors the existing Social Security Fund's employer-and-employee split, but it is a separate scheme with its own registration requirement and its own contribution stream, not an extension of Social Security itself. An employer that already runs a qualifying provident fund or equivalent benefit for its staff is exempt from the new registration and contribution requirement, which gives companies with an existing benefit plan a clear route to avoid the new obligation entirely.
The Postponement
The fund's original start date was October 1, 2025. The Cabinet approved a one-year deferral, moving the effective start date to October 1, 2026, before the original deadline took effect. The postponement is a straightforward one-year delay of the same scheme on the same terms, not a redesign of the contribution rate or the ten-employee threshold, so an employer that was preparing to register in late 2025 now has an additional year before the same registration and contribution obligation becomes due.
The Practical Implication for a Growing Thai FDA or DTAM-Licensed Entity
A foreign investor operating a Thai FDA import-licensed company or a DTAM cannabis export or distribution license-holding entity that is currently under ten employees, but planning to grow past that threshold, should treat the Employee Welfare Fund as a real, near-term line item in headcount-growth budgeting rather than a distant regulatory curiosity. The obligation is not due yet, and the postponement buys a genuine extra year to plan for it, but it is confirmed, dated, and applies automatically once a company crosses the ten-employee threshold in October 2026 or later, unless that company already maintains a qualifying provident fund. This is also additive to, not a substitute for, the Social Security Fund contribution obligation that already applies to every employer regardless of size: a company scaling past ten staff after October 2026 will be running both statutory contribution streams side by side, each with its own registration and its own percentage of monthly wages.
What to Do About It Now
The practical step for a client currently structuring or scaling a license-holding entity is to build the 0.25% employer-side contribution into payroll cost projections for any headcount growth expected around or after October 2026, and to evaluate now whether an existing or planned provident fund benefit would qualify for the exemption, since setting that up in advance is simpler than registering for the new fund cold once the deferral period ends. Structuring a Thai entity's compliance obligations correctly from the start, including payroll-related statutory requirements like this one, is part of how DeeMED supports clients forming and scaling a Thai company to hold a Thai FDA or DTAM cannabis license.
